Sedit,I said DILUTED HNO3 that means  3 Cu + 8 HNO3(aq) = 3 Cu(NO3)2 + 2 NO + 4 H2O

If you start with concentrated HNO3 you will get firstly NO2 and than NO.
If you stat with diluted HNO3 you will get only hint of NO2 which is product of NO reacting with
leftover O2 in apparatus and than mostly pure NO.
It is next to impossible to avoid oxidation of NO to NO2 expect if you are working under inert gas and in this reaction you need exposure to the O2 in prolonged time,you need only small amount of NO and looks like that NO2 doesn't bother that reaction at all. Beside Cu+HNO3(aq) are one of the most readily available chemicals. Correct me if I am wrong.
