FEATURED CASE

The Texas Legislature has set an example for the nation by establishing independent, expert oversight for Texas crime labs.

HB 1068, signed into law by Governor Perry, provides Texans with the means of ensuring the quality of forensic evidence that is used to convict the guilty and protect the innocent. Where problems are identified, the new Texas Forensic Science Commission is empowered to investigate, identify the sources of the problems, recommend corrective action, and demand effective implementation. Texas will now also surely qualify for up to millions of dollars in federal forensic science improvement grants. Without this legislation, the ability to qualify for those dollars was in doubt.

The state’s history of crime lab problems has delayed justice, distracted police and prosecutors, victimized the innocent, and allowed the guilty to remain free. This legislation will improve not only the quality of the Texas Criminal Justice system, but perhaps as importantly, Texans’ faith in that system.

Senator John Whitmire, Chairman of the Senate Criminal Justice Committee, and Senator Juan Hinojosa, Senate sponsor of HB 1068, deserve special praise for their leadership – as well as their staff for their work – on this issue. Senator Ellis also deserves credit for the critical role he played in seeing this bill through. Representative Driver is to be commended for his leadership in the House, and Representatives Frost and Keel for their instrumental support of this bill. While often unsung, the hard work all of these legislators’ staff must also be recognized in this effort.

At the insistence of some members of the House, the law includes changes in Texas law regarding the collection, storage, and accessibility of DNA records. We have serious concerns about the potential for an extraordinary expansion of DNA databases of Texas citizens who have not been convicted of a crime. The Innocence Project will monitor the process and work with others to insure any new authority is not misconstrued or abused.

This Commission will only be as strong, independent and expert as those appointed to it. The Innocence Project will continue to offer its assistance to the appointing authorities and the Commission itself as it moves forward.

We commend the Texas Legislature for its strong action to protect Texas justice. This Commission can serve as a model for other states interested in providing its criminal justice system – and thus its citizens – the same protections.

The recent case of Jimmy Ray Bromgard exposes the perils of junk science in the courtroom. Bromgard was convicted in 1987 of the brutal rape of an eight-year-old girl in Billings, Montana. The fraudulent testimony of the state's forensic scientist played a huge role in Bromgard's wrongful conviction, testifying that the head and pubic hairs found on the victim's bed sheets matched Bromgard and would matched less than one in ten thousand (1/10,000) people in a given population. His testimony and statistics were based not on science but only on baseless conjecture. In light of Bromgard's exoneration and release, six eminent forensic scientists have reviewed the forensic testimony and issued a report.

boo hoo oh i am so fucking sad for new - he got fucked and he got fucked royal style. welcome to the real world - new you dont make the laws dude and if you wanna play big boys games dont start crying fowl play when they catch up with you and slam your ass in jail - dont worry i am sure there is someone you can grass out to save yourself.

1.Hey NEW, Im not familual with your senario or case, But Swip sais they need phisical evidence to charge you with a piticular substance.
2.How many people were involved (busted) and arested ???
3. Can they bee trusted to keep there mouth shut?????
4.And how much of the perticular substance is classed as personal use, Or if its over a certin amount it would be a trifficable amount if its more than that its a commercial amount.
But if they only have traces swip would bee teling them to go shove them charges up there ASS.
Anyway ,Swip agrees with 2spun, Plea NOT GIULTY, or maybee reserve your PLEA, Just an idea dude.
Swip went to goal for atempted manufacturing of MDMA & MDA and all they found were traces of ----, along with PSE.
